The need for new legislation in the reign of Alfonso X of Castile ( 1252-1284) had been perceived even earlier. Alfonso’s father, Ferdinand III (reigned 1217-1252) had spent nearly a quarter of a century (1224-1248) in extending Castilian authority by means of his Andalusian campaigns, concluded for all practical purposes with the capture of Seville after a long, arduous siege. The release of energy meant that royal attention could tum to confronting the political, economic, and social needs arising from the long period of warfare, a time in which scarcities, inflation, and displacements of population had produced fundamental changes in both old and newly acquired parts of the realm.

Ferdinand and Alfonso - finding inspiration and models in the unitary character they saw in Visigothic law, in the increasing contact with new legal ideas from Italy and familiarity with Justinianean codification, and in some examples of the European trend towards new codification provided by the publication of canon law (1234) and of new civil codes in Valencia (1238-1239), Aragon (1247), and France (1254 )-planned a legislative project that Ferdinand’s death would leave Alfonso to complete. Among the initial works in the project, all produced by 1255, were the Repartimiento de Sevilla, or royally commissioned and approved allotment of real estate acquired from the Moslems as a result of the recent conquest;’ the Espéculo, a general code for all royal judges in Castile? the Fuero Real for individual municipalities in Castile.ê and the Setenario, an ethical guide for the education of heirs to the Castilian throne.

In the light of present knowledge, the Espéculo and the Fuero Real are virtually simultaneous in origin, both apparently dating from the first years of Alfonso’s reign, although they may have been conceived and the project even initiated towards the end of the reign of Ferdinand III. As I suggest in my edition of the former, the two works seem to have existed in a symbiotic relationship. The Espéculo, as a code containing principles, exegesis with or through examples, and punishment prescribed for transgressions, was planned as a kind of master version to guide royal judges throughout Castile.

The Fuero Real, in comparison with the Espéculo a simplified version formulated in terms of prescription, examples, and penalties, was applicable in the municipal jurisdictions to which the code was granted and a copy was sent. Whether or not the Espéculo was actually promulgated remains subject to dispute, but if in fact it were promulgated (as I am inclined to think it was), the duration of its validity would have extended only from 1255 to 1272. The prologue and much of the text later entered the composition of the Siete Partidas (1256-1265 ), especially the Second and Third of these, but the Siete Partidas as a code did not become operative before 1348 when they first entered Castilian law in a suppletory capacity. By then the Espéculo, if one assumes its promulgation, had long since ceased to exist as a code in force.
